ORDER

This writ petition is directed against the impugned order dated 05.08.2022 passed by the learned Senior Civil Judge & JMFC, Shiggaon sitting at Savanur in O.S. No. 164/2017 (old O.S. No. 89/2015) whereby the application, I.A. No. 12 filed by the petitioner under Order VI Rule 17 CPC seeking for amendment of the written statement, was rejected by the trial Court.

2. I have heard learned counsel for the petitioners and learned counsel for respondent No.1 and perused the material on record including the impugned order. Notice to respondents No.2 to 6 is dispensed with at the request of the counsel for petitioners.

3. A perusal of the material on record will indicate that the respondent No.1 instituted the aforesaid suit for partition and separate possession and for other reliefs in relation to the suit schedule immovable properties. In the said suit the petitioners herein are arrayed as defendants No. 3, 4, 5 and 8 respectively and they are contesting the suit. After completion of trial
