This Civil Miscellaneous Petition is filed under Section
11(5) of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator to resolve the dispute arose between the petitioner and respondent in terms of Clause
15(g) of the Distribution Agreement dated 13.07.2016.
2. The brief facts leading rise to filing of this Civil Miscellaneous Petition are as under–

The respondent being aware of the goodwill, business structure and quality of products offered by the petitioner approached the petitioner and requested them to designate them as an Authorised Distributor of the petitioner. On further negotiations, the petitioner executed an Authorised Distribution Agreement dated 13.07.2016 in favour of respondent. In terms of the said agreement, the respondent agreed to purchase the petitioner’s products on a non-exclusive basis, across different product categories and to distribute the same in the region of Mumbai/Maharashtra.
4. The respondent agreed to purchase the goods and maintain satisfactory credit with the petitioner by clearing all pending dues promptly as and when the Company raised invoices. In terms of Clause 9 of the said Agreement, the respondent was perm
