Accused No.4 in C.C.No.28965/2021 pending before the Court of Chief Metropolitan Magistrate, Bengaluru arising out of Crime No.74/2020 registered by Mahalakshmipuram Police Station, Bengaluru for the offences punishable under Sections 143 , 147, 148, 323 , 324 and 307 read with Section 149 of IPC is before this Court under Section 438 of Cr.P.C .

2. Heard the learned counsel for the parties.

3. F.I.R. in Crime No.74/2020 was registered by Mahalakshmipuram Police Station, Bengaluru against Kothi Manja and four others for the aforesaid offences. The petitioner was arrayed as accused No.4 in the FIR. During the stage of investigation, anticipatory bail application filed by the petitioner and other accused persons in Crl.Mis.Nos.3652/2020 and 4540/2020 were allowed on 06.07.2020 and 31.08.2020 respectively. Subsequently, the investigation in the case was completed and the charge sheet has been filed. Before the committal Court, accused Nos.1, 2, 4 and 5 had not appeared and therefore, a split up case was registered as against them in C.C.No.28965/2021 and the case as against accused No.3 was committed and the same is now pending before the Jurisdictional Sessions Court in S.C.No.1
