This appeal is preferred against the judgment of the learned Single Judge dated 19.07.2022 in W.P.No.6690/2021, the appellant herein was the fourth respondent in the writ petition.
2. The writ petition was filed challenging Annexure -A endorsement issued by BDA dated 22.02.2021. The learned Single Judge after considering the contentions advanced in all sides found that the statement in Annexure - A i.e. the property in question was notified as park zone in the Master Plan was erroneous since the sanction of the Master Plan was on the premise of acquisition of the property with the appellant herein as a beneficiary. It was found that the notification by which land was sought to be acquired for the benefit of the appellant herein stood quashed by learned Single Judge of this Court, which was confirmed by Division Bench and finally affirmed by the Hon'ble Apex Court in the year 2004. It is submitted that the acquisition itself having been quashed, there was no question of including the property in question, which was a private property as park zone in a Master Plan of the year 2015.
