JUDGMENT
2. For the sake of convenience, the parties are referred to as per their rankings before the E.S.I. Court.
4. Smt. Geethadevi M.P., learned counsel appearing for the appellants has raised the following contentions:
Secondly, the ESI Court has not given any reasoning and the impugned order is passed without application of mind. The ESI Court has erred in holding that M/s.Unique Detective and Security Services (P) Ltd. has paid contribution to the employees and there is no clarity in the order as to whether the contribution paid by M/s.Unique Detective and Security Services (P) Ltd. In respect of the employees who were working in the applicant – Establishment. Hence, she sought for allowing the appeal.
Firstly, before passing the order under Section 45-A of the ESI Act, the Corporation requires to give a notice to the immediate employer, i.e, M/s.Unique Detective and Security Services (
