ORDER

The petitioner-accused No.4 is before this Court seeking grant of bail under Section 439 of Cr.P.C. in Crime No.91/2024 of Kaggalipura Police Station, pending on the file of the learned II Additional CJM Court, Bangalore Rural District, Bengaluru registered for the offences punishable under Sections 392 and 397 of the Indian Penal Code (for short 'IPC'), on the basis of the first information lodged by the informant Padmavathi.

2. Heard Sri. Omkaresha, learned counsel for the petitioner and Sri.M.Divakar Maddur, learned High Court Government Pleader for the respondent -State. Perused the materials on record.

3. In view of the rival contentions urged by the learned counsel for both the parties, the point that would arise for my consideration is:

    “Whether the petitioner is entitled for grant of bail under Section 439 of Cr.P.C.?” My answer to the above point is in ‘Negative’ for the following:

4. The petitioner arrayed as accused No.4 is before this Court. It is stated that he along with other accused committed dacoit and robbed valuables from the house of informant, including cash and gold. The materials on record disclose that there was joint recovery at the instance
