This petition is filed by the petitioner/wife under Section 24 of CPC seeking to transfer MC No.4564/2021, pending on the file of the Principal Judge, Family Court, Bengaluru to the Family Court, Belagavi.
2. Heard Miss.Aditi Naik, learned counsel appearing for the petitioner/wife. Though the notice of this petition is served on the respondent, he remained absent and placed exparte.
3. Learned counsel appearing for the petitioner submits that the marriage between the petitioner and the respondent was solemnized on 18.03.2010 and there were serious marital disputes between the parties, hence, she started residing along with her parents at Belagavi. It is submitted that the respondent/husband use to harass the petitioner, which compelled her to reside along with her parents at Belagavi and she has also instituted proceedings in Crl.Miscellaneous No.113/2023, which is pending before the Family Court, Belagavi. It is further submitted that the respondent/husband has filed M.C No.4564/2021 seeking dissolution of marriage and the said proceedings is pending before the Family Court, Bengaluru and it would be difficult for the petitioner/wife to travel to Bengaluru from Belagavi.
