ORDER

Heard the learned counsel for the petitioner and the learned High Court Government Pleader appearing for the respondent - State.

02. The petitioner is before this Court seeking the grant of bail under Section 439 of Cr.P.C. in connection with Crime No.158/2023 registered for the offence punishable under Section 302 of IPC , by the Ashok Nagar Police Station, Kalaburagi.

03. The prosecution alleges that the deceased – Shaheenabanu was married earlier to accused – petitioner and out of such marriage a son was born, by name Iqbal.

Thereafter, the deceased had developed illicit relationship with others. After the divorce, she had married one Shaik Hyedar and lived with him for about 06 years, during which time a daughter was born. Thereafter, the said Shaik Hyedar came to know that the deceased – Shaheenabanu was involved in prostitution. Therefore, he left her taking his daughter with him. Thereafter, there was a quarrel between the deceased – Shaheenabanu and the said Shaik Hyedar and she had brought the child to her mother i.e., Imamabi (CW.1) and left to child with her.
