There is no representation on behalf of the
appellant even though the matter was passed over twice.

The order sheet discloses that the appellant was
never interested in prosecuting the appeal even though learned
counsel for the respondent has been insisting to hear the
matter on merits.

The order sheet dated 13/07/2022, 27/07/2022,
19/09/2022 and 20/02/2023 evidence the fact that the
appellant is not interested in prosecuting the appeal. The
appeal is of the year 2016 and it is the second round of
litigation being dragged on indefinitely without any purpose.
Hence, I do not find any reason to adjourn the matter.
Accordingly, the appeal is dismissed for non-prosecution.
