The learned counsel for the petitioners files a memo.

The memo reads as following:

“1. The Petitioner had filed the above Writ

Petition challenging the sale notice issued by

the Respondent bank dated 22.09.2023 for an

e-auction which was to be held on 27.10.2023

between 12 PM to 5 PM but the same is failed,

due to no bidders identified and this Hon’ble

court be pleased to permit the Petitioner to

withdraw the above Writ petition with a

liberty to file a fresh Writ Petition as and

when need arises. The Memo may be taken

on record in the interest of justice and

equity.”

In terms of the memo, the writ petition is disposed

as withdrawn.
