Viveknagar Police Station, Bengaluru for the offences
punishable under Sections 8(c), 22(c) and 25 of Narcotic
Drugs and Psychotropic Substances Act, 1985 (for short
hereinafter referred to as 'NDPS Act), is before this Court
under Section 439 of Cr.P.C.

Heard the learned counsel for the parties.

On the report dated 01.06.2023 submitted by
Police Sub-Inspector of Vivkenagar Police Station, Station
House Officer of Vivkenagar, Bengaluru has registered
F.I.R., in Crime No.81/2023, against the petitioner and
another for the aforesaid offences. In the report dated
01.06.2023, it is averred that on 01.06.2023 at about 7.15
a.m., when the complainant was in the Police Station, she
received a credible information that near D-mart mall,
Koramangala two persons aged about 24-25 years were
selling
MDMA
powder
to
the
public.
Immediately,
thereafter, complainant along with staff and independent
panchas raided the alleged spot and apprehended the two

persons who were found in the spot in two wheeler. The
said persons on enquiry revealed their names as
Mohammed Jalal and Mohammed Salim. They also stated
that they were in possession
