THIS PETITION COMING ON FOR HEARING THIS DAY,
THE COURT MADE THE FOLLOWING:
It is submitted that Sri Papegowda, learned
counsel representing the petitioner is no more. It is
also noticed that Sri Mahadev S. Patil has signed the
vakalath. He submits that he has no instructions from
the
petitioner
and
he
would
take
necessary

instructions from the petitioner who is in hospital and
gone with the case.

Since a case is filed against the Anti
Corruption Bureau, who is the first respondent and the
same has seized to exist, the matters pertaining to
Anti Corruption Bureau is now remitted to Lokayuktha,
the
present
petition
would
not
survive
for
consideration.
3.
However, petitioner is at liberty to file fresh
petition if he is so advised.
4.
Hence, the following order is passed:
ORDER
Criminal petition stands dismissed with liberty to
approach this Court with a fresh petition impleading
Lokayuktha as a party, if so advised.
