Accused no.2 in Crime No.267/2023 registered by Hassan

Extension Police Station, Hassan District, for the offences

punishable under Sections 341, 397 IPC and Section 27 of the

Indian Arms Act, 1959, is before this Court under Section 438

Cr.PC.

Heard the learned Counsel for the parties.

On the basis of the complaint lodged by Sachin.K.M., S/o

Manjegowda dated 04.11.2023, FIR in Crime No.267/2023 was

registered by Hassan Extension police against Ajay and the

petitioner herein for the aforesaid offences. Apprehending

arrest in the said case, petitioner had filed Crl. Misc.

No.1375/2023 before the Court of II Addl. District & Sessions

Judge, Hassan, which was dismissed on 21.11.2023. Therefore,

he is before this Court.

Learned Counsel for the petitioner submits that the

petitioner and the complainant are known to each other and the

incident in question is a road rage and the said incident has

been exaggerated and a false complaint has been lodged. He

submits that accused no.1 has been already enlarged on

regular bail in the case and the petitioner has no criminal

antecedents. Accordingly, he prays to allow the petition.

From a perusal of the complaint averment
