and Sri.Somashekar., learned counsel for respondent No.1

has appeared in person.

The facts are quite simple and are stated as

under:

It is stated that the petitioner is in the business of

fabrication by name and style as M/s Sunrise Self Adhesive

Tapes. It came to know about the availability of industrial

land in the Karnataka Industrial Area Development Board

at Gowribidanuru Industrial Area Phase-I and applied for

allotment of a site. Based on the availability of the site, the

Board allotted plot No.IP 37 Gowribidnur Industrial Area

Phase-I on 04.06.2012 measuring 4047 Sq.mtrs. It is said

that while handing over the possession and executing the

lease deed only 3400 Sq.mtrs of the land was given.

It is stated that the total price of the site was

Rs.20,58,381/- (Rupees Twenty Lakh Fifty Eight Thousand

Three Hundred and Eighty One only) for 3400 Sq.mtrs.

However, the Board collected a sum of Rs.24,50,000/-

(Rupees Twenty Four Lakh Fifty Thousand only) for 4047

Sq.mtrs. The petitioner obtained a loan from the Syndicate

Bank, Whitefield Branch, Bangalore for the purchase of the

leasehold rights after obtaining NOC from the Boar
