This appeal is filed by the appellant under section

14(A)(2) of the Scheduled Castes and Scheduled Tribes

(Prevention of Atrocities) Act for setting aside the order

of dismissal of the petition filed by the appellant seeking

regular bail under Section 439 of Cr.P.C. passed by the I

Additional District and Sessions Judge, Ramanagara in

Crl.Misc.No.379/2023 dated 31.05.2023 in respect of

Crime No.107/2023 registered by Harohalli Police Station

for the offences punishable under Sections 363, 376(2)(n),

376(3) of Indian Penal Code (for short 'IPC') and Sections

4 and 6 of POCSO Act, 2012, and Sections 3(1)(w)(i), 2(5)

of the Scheduled Castes and Scheduled Tribes (Prevention

of Atrocities) Act (for short 'SC & ST Act').

The case of the prosecution is that on the

complaint filed by the grandmother of the victim, the

Police registered FIR on 12.04.2023. It is alleged that the

appellant/accused abducted the minor girl aged about 15

years 9 months and committed sexual intercourse with

her. Sub
