ORDER

This petition is filed under Section 438 of Cr.P.C. by the petitioner seeking bail in Crime No.42/2023 of Tilak Nagar Police, Bengaluru, for the offence punishable under Section 306 read with Section 34 of IPC.

2. Heard the arguments of learned counsel for the petitioners and learned HCGP and perused the records.

3. The allegation against the accused Nos.1 to 4 mentioned in the FIR is that the deceased Wasim Akram had fell in love with one Sabahat about five years prior to 25.02.2023. It is alleged that about one and half months prior to the said incident, there was panchayat convened between the family members of the deceased and also the girl Sabahat. In the said panchayat the deceased Wasim Akram was advised about his activity and he should be away from Sabahat as her marriage has been fixed. In this background, it is alleged that the accused Nos.1 to 4 have abetted the deceased Wasim Akram to commit suicide, consequent upon such abetment, the deceased has committed suicide on 25.02.2023.

4. Sri. Vishnumurthy, learned counsel for the petitioner has contended that this Court has already considered the matter in connection with accused Nos.1 to 4 in Criminal Petition No.3569/20
