JUDGMENT
The defendant No.4 in O.S. No.26177/2022 on the file of the LXXII Additional City Civil and Sessions Judge, Mayo Hall, Bengaluru, (henceforth referred to as 'the Trial Court') has filed this appeal challenging an order dated 08.02.2024, by which applications (I.A. Nos.1 and 2 of 2022) filed by the plaintiff under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908 (for short, ‘CPC’) were allowed and the defendant and their henchmen were temporarily restrained from interfering with the plaintiff’s possession of the suit schedule property pending final disposal of the suit in O.S. No.26177/2022.
2. The parties shall henceforth be referred to as they were arrayed before the Trial Court.
3. O.S. No.26177/2022 was filed for the following reliefs:
"i. Direct the Defendant No. 1 to 3 to execute a sale deed in favor of the plaintiff no.1 as per the registered sale agreement dated: 24/04/2019 and;
ii. Grant permanent injunction to the plaintiffs against the defendants along with their representative, legal heirs, henchmen etc, not to disturb the peaceful possession and enjoyment over the suit schedule property and;
iii. Declare the sale deed dated: 03/08/2020 as null and void
