ORAL ORDER
Accused No.2 in S.C.No.99/2023 pending before the Court of II Addl. District & Sessions Judge, Hassan, arising out of Crime No.274/2015 registered by Hassan Extension Police Station, Hassan, for the offences punishable under Sections 143, 144, 147, 148, 120B, 302, 307 r/w 149 of IPC, is before this Court under Section 439 of Cr.P.C.
2. Heard the learned counsel for the parties.
3. Learned counsel for the petitioner submits that on the merits of the case the petitioner was earlier granted anticipatory bail by the Coordinate Bench of this Court in Crl.P.No.8191/2017 disposed of on 08.11.2017. After filing of charge sheet, the petitioner was granted regular bail by the Sessions Court in S.C.No.169/2017 by order dated
22.10.2021. Since the petitioner had not appeared before the trial Court, thereafter NBW was issued against him on 08.08.2022 and his presence was secured on 24.07.2024 and on the said day he was remanded to judicial custody. He submits that in other criminal cases registered against him, petitioner has been already granted bail. Accordingly, he prays to allow the petition.
