8165/2023 AT ANNX-A AND ETC., THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER
1. The petitioners are defendant Nos.2 and 3 in OS.No.8165/2023, pending on the file of XV Additional City Civil and Sessions Judge, Bangalore. At the request of plaintiffs the trial Court has granted an ex-parte ad-interm injunction against the defendants on I.A.No.1 filed in the said suit. It is submitted that subsequently, the petitioners herein have entered appearance and have argued on the interlocutory application. However, the trial Court is not deciding on the said interlocutory application.
2. The trial Courts are expected to decide the application filed under Order 39 Rule 1 and 2 read with Section 151 of CPC as expeditiously as possible. Hence, in my opinion this is a fit case to direct the trial Court to decide the interlocutory application filed under Order 39 Rule 1 and 2 read with Section 151 of CPC in OS.No.8165/2023 as expeditiously as possible, but not later than thirty days from the date of receipt of this order.
3. Further, as only a direction is being issued to the trial Court to decide the case as expeditiously as possible, notice to respondents is not be considered as necessary.
Ordered accordingly.
Registry is directed to communicate a copy of this order to the trial Court.
