2. Heard the learned counsel appearing for the appellant and the learned counsel appearing for respondent.
4. The factual matrix of the case of the plaintiff before the Trial Court while seeking the relief of possession that the plaintiff is a registered Trust undertaking social, cultural, religious and charitable activities. It is functioning based on the donations given by the general public. The Trust of the plaintiff is the owner of the suit schedule premises. The defendant approached the plaintiff as a tenant, but the plaintiff agreed to the indenture of undertaking by the defendant to pay security deposit of Rs.6,000/- and donation of Rs.300/-
