In this appeal, the State has challenged the judgment dated 19.11.2016 passed by the learned VI Additional District and Sessions Judge at Tumakuru, in Special Case No.78/2015 acquitting the accused of the offences punishable under Sections 417, 366 and 376 of IPC.

3. Brief facts of the case are, PW-12/Allabaksh was constructing a house in TUDA Layout situated at Ring Road, Tumakuru. He had erected sheds besides his construction site to house the labourers. PW-6 hired the services of PW- 1/Avalappa, PW-2/victim, CW-3/Gangamma, CW- 4/Durgappa, CW-5/Yellappa. They were all residing in the sheds erected by PW-12. The accused, who was also residing in one of the sheds, came in contact with PW- 2/victim.
