In this appeal, the State has challenged the judgment dated 19.11.2016 passed by the learned VI Additional District and Sessions Judge at Tumakuru, in Special Case No.78/2015 acquitting the accused of the offences punishable under Sections 417, 366 and 376 of IPC.
2. For the sake of convenience, parties shall be referred to as per their status before the Trial Court.
3. Brief facts of the case are, PW-12/Allabaksh was constructing a house in TUDA Layout situated at Ring Road, Tumakuru. He had erected sheds besides his construction site to house the labourers. PW-6 hired the services of PW- 1/Avalappa, PW-2/victim, CW-3/Gangamma, CW- 4/Durgappa, CW-5/Yellappa. They were all residing in the sheds erected by PW-12. The accused, who was also residing in one of the sheds, came in contact with PW- 2/victim. On 24.07.2015 at about 12 noon, taking advantage of victim being alone in the shed, compelled and forced her to go with him and thereby he kidnapped her with an intention of forcing her to marry him and for forcing/seducing her into illicit sexual relations.
