Bharat Electronics Ltd1 has preferred this Writ Appeal

challenging the judgment dated June 3, 2014 passed in

W.P. No. 19604/2013.

For the sake of convenience, parties shall be

referred to as per their status in the Writ Petition.

Brief facts of the case are, in 1998, petitioner

was appointed as a Canteen Officer in BEL. On attaining

the age of superannuation, he retired from service on April

30, 2013.

On June 19, 1996, in supercession of previous

Orders2, BEL issued an Office Order3 known as BEL Retired

Employees9 Contributory Health Scheme (Revised)4 which

came into effect from August 1, 1996. On January 19,

2011, BEL passed a subsequent Order5, amending clause

3.1.1 of health scheme and prescribed an eligibility period

of minimum fifteen years of service for employees retiring

on superannuation, to become eligible for the Health

Scheme.

The original writ petitioner submitted letters6

seeking benefits under the health scheme. As there was no

response, he filed the instant writ petition, with a prayer

inter alia to quash the amendment to clause 3.1.1 of the

health scheme and to direct the BEL to grant the benefits
