The petitioner is before this Court calling in question the
proceedings in C.C.No.5645/2018 pending before the II
Additional Chief Metropolitan Magistrate, Bangalore arising out
of Crime No.297 of 2017 registered for offences punishable
under Sections 427 and 279 of IPC and Section 2 of Karnataka
Prevention of Destruction and Loss of Property Act, 1981.
2. Heard Sri. P.P. Hegde, learned Senior counsel appearing
for the petitioner and Sri. K.S.Abhijith, learned High Court
Government Pleader for respondent No.1.
3. The brief facts as projected by the prosecution are as
follows:

The petitioner is an animal rights activist and an animal
welfare officer of Animal Welfare Board of India which the
petitioner claims to be a registered organization. On 14-10-2017
the petitioner receives some information with regard to 14 desi
cattle hidden near Abrar Medical Stores kept ready for their
slaughter. On receipt of the said information, the petitioner visits
the spot for verification and on verification it was found that the
said cattle were in fact slated to be slaughtered. The petitioner
then reports the incident to the Police immediately and the
