This petition is filed under Section 439 of Cr.P.C., seeking

regular bail of the petitioner/accused in Crime No.01/2022 of

Anti Corruption Bureau Police Station, Madikeri District, for an

offence punishable under Section 7(a) of the Prevention of

Corruption Act (Amendment Act, 2018) (‘the PC Act’ for short).

Heard the learned counsel appearing for the

petitioner and the learned Special Public Prosecutor appearing

for the respondent/ACB.

The factual matrix of the case of the prosecution is

that the complainant in the complaint dated 18.01.2022, made

an allegation in the complaint that the complainant’s wife is the

member of the Grama Panchayath and she spoken to the Deputy

Tahasildar with regard to the application given by her. Hence,

the petitioner had collected her mobile number and also

collected the mobile number of her husband. That on

17.01.2022, the petitioner herein made phone call to the

complainant’s wife at around 5:45 p.m, and asked her to come

and meet him. On that day, at 6:30 p.m, she went and met the

petitioner and he had promised that he would grant the land,

which is adjacent to their land and demanded an amount of

Rs.2.5 Lakhs for each acre, in all Rs
