The petition is filed under Section 439 of Cr.P.C., seeking

regular bail of the petitioner/accused No.1 in respect of Crime

No.124/2021 registered by J.C.Nagar Police station, Bengaluru

City, for the offences punishable under Sections 143, 145, 147,

148, 353, 332, 354, 354(b), 323, 324, 152, 153, 504, 506 read

with 149 of IPC and Section 3 of Prevention of Damage to Public

Property Act, 1984 and Section 27(b) of the Narcotic Drugs and

Psychotropic Substances Act, 1985.

Heard the learned counsel appearing for the

petitioner and the learned High Court Government Pleader

appearing for the respondent-State.

The factual matrix of the case of the prosecution is

that a foreign nationale was in the Police custody. This petitioner

along with other accused persons by forming an unlawful

assembly protested before the Police, abused in a filthy language

and also assaulted with their hands. As a result, the police

personnel have also sustained the injuries. Hence, the police

have registered a case, investigated the matter and filed the

charge-sheet.

The learned counsel appearing for the petitioner

would submit that this petitioner is in custody from 02.08.2021
