The present appeal is filed by the State against the order
of acquittal for the offence punishable under section 307 of IPC
against the accused. However, the trial Court after having
considered the nature of injury, convicted the accused for the
offence under section 324 of IPC. The accused has not preferred
any appeal against the conviction passed under Section 324 of
IPC.

The gist of the case is that the complainant-Praveena
(PW.9) has given statement in the hospital while he was taking
treatment which reads as follows:
On 30.05.2014 at about 10.00 p.m. when he entered the
house by wearing slipper, the accused has started scolding that
scoundrel you are wearing my slipper and going and also he
further scolding that the complainant has taken Rs.7,000/- from
Abusaheba and further he has threatened that he would put the
complainant to hey stock and burnt him. As such, he took the

knife and assaulted the complainant on left ear and caused
injury on the head. The complainant sustained bleeding injury
and ran away from the clutches of accused and went to the
hosue of Sridhara Poojary thereby they have shifted the
complainant to the Government hospital, Kalasa at about 12.15
