Unfortunate injured/claimant is before this Court

seeking enhancement of compensation against the

impugned judgment and award dated 30.04.2015

made in MVC No.350/2006 on the file of the I

Additional Senior Civil Judge and CJM and MACT,

Mysuru (hereinafter referred to as the 8the Tribunal9

for

short)

awarding

total

compensation

of

Rs.20,30,550/- with interest @ 6% p.a. from the date

of the petition till the date of realization.

The claimant has filed the claim petition

under the provisions of Section 166 of the Motor

Vehicles

Act,

claiming

compensation

of

Rs.3,06,93,533/- with interest contending that on

05.11.2005 at about 12.00 pm, when he was riding

the motor bike bearing registration No.KA-09-EE-6697

from Nrupathunga Restaurant towards Gokulam Park

Road and while he was returning to his residence at

Brindavan extension, Mysore, at that time, the driver

of the Skoda Octavia Car bearing registration No.KA-

09-MB-9 drove in a rash and negligent manner dashed

and crashed into the motor cycle from behind and was

dragged to a distance. Due to the impact, claimant

has sustained grievous injuries i.e., crushing of left

foot and fracture to the left collar bone and two

pedestrian
