This petition is filed by the accused Nos.1 and 2

under Section 439 of Cr.P.C., seeking bail in Crime

No.133/2022 registered for the offence punishable under

Sections 323, 324, 341, 114, 307, 504, 506 read with

Section 34 of IPC.

The case of the prosecution is that, one Prakash

has filed a complaint, stating that, one Mr. Vishal Gudihal

(accused No.1) had picked up quarrel with him about two

months ago near Mavanur Road, Balaji Bar. Keeping the

said enmity in mind, that on 16.10.2022 at about 6.00

hours, when the complainant was proceeding from his

house towards his shop, Vishal Gudihal (accused No.1),

took three persons with him and came on two motorcycles

and stopped the complainant at Old Hubballi Netaji colony

road and accused No.1 forced the complainant to sit on

the Honda Dio vehicle which he had brought. When the

complainant refused to sit on the said vehicle, Vishal

(accused No.1) and three other persons who came with

him got down from the vehicle and Vishal (accused No.1)

by holding the shirt of the complainant dragged him to the

open space beside the road and caused hurt and internal

pain by fisting on the chest, blow on the left eye of the

complainant and remainin
