Heard the learned counsel for petitioner and

the learned HCGP and perused the material on

record.

This petition is filed under Section 439

of Cr.P.C. by the sole accused in Crime No.

113/2021 of Halavagilu Police Station, registered

for offences punishable under Section 323, 324,

306 and 201 of IPC.

Gist of the complaint lodged by one Sri.

Karadi Siddappa S/o. Karadi Mallappa is that,

deceased by name Karadi Holiyappa is his elder

brother. The petitioner is the son of the deceased.

business

at

Jagaluru.

Whenever he was visiting his village, he used to

quarrel with his father. On 31.10.2021 at about

6:15 am complainant received the information

about his brother committing suicide. On enquiry

with his grand son by name Shashikumar, he came

to know that on 30.10.2021 at about 9:00 pm

while the deceased and other family members

were having diner, a quarrel ensued between the

petitioner and the deceased and in the said

quarrel the petitioner assaulted the deceased with

hands and with a plastic tray box and instigated

him to commit suicide. In view of the said

instigation, the deceased committed suicide.
