This appeal is filed by the State impugning the
judgment of acquittal rendered on 09.06.2015 in Sessions
Case No.107/2010 on the file of Additional Sessions Judge,
Raichur. In terms of the said judgment, the accused are

acquitted for the offences punishable under Sections 376,
504 and 506 read with Section 34 of Indian Penal Code,
1860 (for short ‘IPC’).

The facts narrated in the complaint can be
summarized as under:-
The complaint dated 21.10.2019, is lodged by the
victim aged 30 years. On 26.07.2009, when the family
members of the complainant had been to Kalmaal
Kariyappatata's fair, the complainant was alone in the
house. It is alleged that the accused No.1-Venkatesh came
to her house around 1.30 p.m., and knowing that nobody
except the complainant was in the house, asked her to
fetch a glass of water and later followed the complainant
after locking the door from inside. The complainant getting
scared, told the accused not to close the door as the
neighbours are likely to misinterpret the situation. It is
alleged that the accused all of a sudden pulled her and
started touching her private parts and despite the efforts
made by the complainant to escape from his clutches, he
