FOLLOWING:

ORDER

Respondent No.7 lodged a complaint with 3rd

respondent alleging that the petitioner who was the

Ex-President of Huliyurdurga Gram Pancchayat though

ceased to be the President on 23-6-2014 by using

Dongle made payments to the beneficiaries under

MGNAREGA Scheme from 27-8-2014 and to take

appropriate

action

against

the

petitioner.

3rd

respondent, after conducting an enquiry passed an

order dated 29-11-2014 stating that the petitioner has

used the Dongle for the purpose of making payment

to the beneficiaries in violation of the guidelines and

directed the Chief Executive Officer of Zilla Panchayat

to initiate criminal prosecution. Against the said

order, petitioner filed an appeal before the 2nd

respondent. The 2nd respondent, by order dated

02-05-2015 dismissed the appeal confirming the order

passed by the 3rd respondent. Against which, the

present petition is filed.
