Petitioner who is arraigned as accused No.2 has come

up with this petition under Section 482 of Cr.P.C to quash

the criminal proceedings initiated against her for the offence

punishable under Section 138 of Negotiable Instruments Act

(for short 8N.I.Act9) in C.C.No.1655/2019 on the file of Addl

Civil Judge (Jr.Dn.) and J.M.F.C. Dharwad.

For the sake of convenience the parties are

referred to by their rank before the trial Court.

It is the case of the petitioner that in the

complaint she is arraigned as accused No.2. She is one of

the Directors of Maven India Private Limited. However, she is

not at all looking after the affairs of the company. She has

not signed the subject cheque. Complainant who is arraigned

as respondent was never provided any service to the

company in question or to the petitioner/accused No.2, so as

to make the petitioner/accused No.2 or company liable to

pay any amount. Accused No.2 never accept any individual

investment in the company. Therefore there is no question of

company or accused No.2 being liable to respondent in any

sum whatsoever. Complaint does not make any case against

accused No.2 and hence the petition.
