SRI. RAMACHANDRAPPA – Appellant

This appeal is filed by the claimant being aggrieved

by the judgment and award dated 04.09.2015 passed by

the II Addl. Senior Civil Judge and MACT, Tumakuru in

MVC No.91/2015.

2. For the sake of convenience, parties shall be

referred as per their status before the Tribunal.

3. In the motor vehicle accident which occurred on

30.10.2014 at 8.30 am on Hosakerepalya Village, Hiriyur

Taluk where the petitioner, a pedestrian was hit by a

motorcycle bearing Regn. No.KA-16-EB-4473 came at high

speed and rashly and negligently dashed against the

petitioner and the petitioner sustained grievous injuries. It

is claimed that the petitioner was aged 35 years and an

agriculturist by profession who also used to vend milk.

Petitioner claimed income of Rs.20,000/- per month. The

injury to the spine has rendered the petitioner to the state

of a quadriplegic. The claim petition filed against the

owner and insurer of the motorcycle was allowed in part,

awarding compensation of Rs.17,75,000/- along with

interest @ 6% p.a. from the date of petition till the date of

payment.
