Heard Sri M.L. Vanti, learned counsel appearing

for the petitioner and Sri Ramesh Chigari, learned High Court

Government Pleader for State.

The present petition is filed under Section

482 of Cr.P.C with the following prayer:

“Wherefore, the petitioner most humbly

prays that this Hon’ble Court may be pleased to

allow

this

petition

and

quash

the

entire

proceedings

in

Spl.C.No.64/2017

(Crime

No.100/2016) on the file of II. Addl. District and

Sessions Judge, Bagalkot for offences punishable

under Section 363, 366A, 376(2)(i), 376(2)(n),

494, 109, 504, 34 of IPC and Section 3(1)(s),

3(2)(va)of SC and ST (Prevention of Atrocities)

Act, 1989 and Section 4 and 6 of POCSO Act and

Section 9 of Child Marriage Restraint Act and all

further proceedings pursuant to therein in respect

of the petitioner herein, in the interest of justice.”

The victim girl lodged a complaint on 02.08.2016 that

she is a minor, belonging to Scheduled Castes and Scheduled

Tribes community and she has been kidnapped and has been

used for forcible sexual intercourse and as such,
