ORAL ORDER

The petitioner has called in question the action of the respondent-Bank in defreezing of Bank Account of the petitioner bearing No.50100421740089 maintained at HDFC Bank Ltd., Marathahalli, Bangalore.

2. It is the case of the petitioner that in terms of the Email communication, the transaction date and disputed amount is revealed and it is clear that the disputed amount is only Rs.2,000/-.

3. It is submitted that in terms of Annexure-C, the disputed amount is Rs.2,000/- and there is no warrant for defreezing of the entire amount in the account mentioned at Annexure-C.

4. Taking note of Annexure-C and the disputed amount is only Rs.2,000/- insofar as Bank Account of the petitioner bearing No.50100421740089 maintained at HDFC Bank Ltd., Marathahalli, Bangalore, the Bank could mark their lien for Rs.2,000/- and order of defreezing would be restricted to such amount.

5. Accordingly, the petitioner is at liberty to deal with the funds beyond Rs.2,000/-. However, in the event there is no instruction for defreezing of account, needless to state, the bank can e
