Heard learned counsel for the parties.
2. This petition is filed under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Section 407 of Cr.P.C. with the following prayer:
“The petition may please be allowed the case at CC No.10301/2023 u/s 354, 323, 324, 504, 506 r/w 34 IPC pending on the file of 1st Addl. Civil Judge and JMFC II Bidar may pleased be transferred to any of the Chief Metropolitan Magistrate (CMM) courts at Bangalore, in the interest of justice and equity.”
3. The facts in brief which are utmost necessary for disposal of the present petition are as under:
A complaint came to be filed by Smt. Ayesha W/o Taufiq with Women Police Station, Bidar alleging the commission of offences under Sections 354 , 323, 324, 504, 506 read with Section 34 of Indian Penal Code which came to be registered in Crime
