Writ of mandamus issued against requiring survey sketches for property registration under established legal precedents.

ORAL ORDER

The grievance of the petitioner in this writ petition is with regard to consideration of representations dated 27.11.2023 and 28.11.2023 filed by the petitioner as per Annexures-.C, D and E to register the sale deeds as claimed by the petitioner.

2. Heard Sri R Srinivasa Gowda, learned counsel appearing for the petitioner and Smt.Navya Shekhar, learned Additional Government Advocate for the respondents.

3. This Court vide order dated 07.11.2023 passed in WP No.17025/2023 (Annexure-B) at paragraph No.4 held as follows:

"4. Having heard the learned counsel appearing for the parties and on careful examination of prayer made in these writ petitions, this Court in Writ Petition No.18939 of 2009 connected with Writ Petition No.14050 of 2012 decided on 18^th March, 2016; Writ Petition No.65235 of 2016 decided on 02^nd January, 2017; and Writ Petition No.24987 of 2018 decided on 15^th June, 2018, directed the respondents therein to register the Sale Deeds in respect of the property described in the Sale Deeds without insisting for production of 11-E sketch (Survey sketch), subject to the petitioners complying all the other requirements as prescribed under the provisions of Indian Registration Act and Registration Rules for registration of Sale Deeds. Following the law declared by this Court in the aforesaid writ petitions, writ in the nature of mandamus is issued to the Registering Authority not to insist for 11- E sketch (Survey sketch) insofar as the registration of Sale deeds are concerned. Accordingly, writ petitions are disposed of."

4. On careful examination of the order made by this Court, it indicates that, the writ of mandamus was issued to the Registering Authority not to insist for 11-E sketch (Survey sketch) insofar as the registration of sale deeds are concerned in respect of the subject land.

5. In that view of the matter, the respondent No.3 is directed to consider the representation dated 27.11.2023, and register the documents in compliance of the order passed by this Court dated 7.11.2023 at (Annexure-B). The entire exercise shall be made within two months from the date of receipt of certified copy of this order.
