MISCELLANEOUS FIRST APPEAL NO. 102618 OF 2018 (MV-D) | MISCELLANEOUS FIRST APPEAL NO. 104402 OF 2017
For the Appellants/Petitioners: SRI. MANJUNATHA G PATIL
For the Respondents: SMT. ARUNA DESHAPNDE, SRI. MANJUNATH G. PATIL
The court modified the compensation awarded in traffic accident claims, emphasizing appropriate future income assessments and adherence to legal standards under the Motor Vehicles Act.
Headnote:This judgment concerns appeals regarding compensation for a road traffic accident resulting in death. The honourable court assessed compensation based on the Motor Vehicles Act, 1988, specifically Sections 166 and 140, indicating the deceased's income and future prospects were inadequately evaluated by the Tribunal. The court determined that the petitioners proved the unsatisfactory assessment of compensation, leading to a modified compensation valuation of ₹13,41,600/- for the petitioners. The respondents challenged the initial compensation as excessive. The appeals highlight critical considerations in compensation valuation and lawful claim procedures under traffic accident cases. In the result, the court dismissed MFA No.102618 of 2018 while allowing MFA No.104402 of 2017 in part, modifying the Tribunal's award.
