ORAL JUDGMENT
The accused in Special Case No.55 of 1999 on the file of the learned Principal District and Sessions Judge at Mysuru, is impugning the judgment of conviction and order of sentence dated 05.12.2011, convicting him for the offence punishable under Section 13 (1)(e) read with Section 13 (2) of Prevention of Corruption Act (for short 'the P.C. Act'), and sentencing to undergo rigorous imprisonment for a period of five years and to pay fine of Rs.32,02,251.15, with default sentence to undergo further rigorous imprisonment for a period of one year. Further to confiscate the cash of Rs.6,73,390/- and gold weighing 380 grams seized from the custody of the accused.
2. Being aggrieved by the same, the appellant/accused has preferred this appeal. During pendency of the appeal, accused died and his son-Sri. B. J. Kumar is brought on record to prosecute the appeal.
