CAV ORDER
The petitioners and respondents in all these cases are common. They are before the Court calling in question an order dated 27-02-2025 passed by the XVII Additional City Civil and Sessions Judge, Bengaluru rejecting the applications filed by the petitioners under Order I Rule 10(2) of the CPC , in the Execution Petitions.
2. Heard Sri Bipin Hegde, learned counsel appearing for the petitioners and Sri Abhinav Ramanand, learned counsel appearing for the respondents.
3. Facts, in brief, germane are as follows: -
In terms of averments in the petitions, the history of the case dates back to 21-07-2007 when a common judgment in O.S.No.7761 of 2004 and connected cases was passed in respect of various properties bearing assessment No.2/3D situated at Channasandra Village, Uttarahalli Hobli, Bangalore South Taluk wherein the judgment debtors/respondents 2 to 7 were permanently restrained from interfering with the peaceful enjoyment of the suit schedule properties by the decree holders.
