Advocates:
For the Appellants/Petitioners: SRI SHISHIRA AMARNATH
For the Respondents: SMT. SPOORTHY V. H.C.G.P., SMT. SARITHA KULKARNI

Previous judgments rendered by the Court set aside analogous fees and bye-laws as ultra vires and unconstitutional, warranting the allowance of the present writ petition.

Headnote:(A) Constitution of India - Articles 226 and 227 - Challenge to bye-law no.3.9 of Bangalore Mahanagara Palike Building Bye-laws 2003 as unconstitutional, illegal, and ultra vires - The Co-ordinate Benches have previously adjudicated and quashed similar levies as ultra vires - The present petition was found to be covered by binding decisions. (Paras 2, 3, 4, 5)

Facts of the case:
The petitioner sought to declare bye-law no.3.9 unconstitutional, quash a demand notice for various fees, and direct the issuance of a building license. The court found that similar issues had been previously adjudicated by Co-ordinate Benches.

Findings of Court:
The present writ petition is allowed based on prior authoritative judgments, and the demand notice is set aside. The BBMP is directed to process the petitioner’s application as per law.

Issues: Whether the bye-law is unconstitutional and the treatment of fees as ultra vires - previously settled in connected cases.

Ratio Decidendi: The court upheld that the current issues are squarely covered by established precedents, thus mandating the allowance of the writ petition.

Result: Writ petition is allowed.
