Quashing of criminal proceedings under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, confirmed due to lack of evidence.

Headnote:This judgment analyzes the application of Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, where the petitioner, accused No.4 in Crime No.253/2020, sought to quash the criminal proceedings against him. The Court evaluated previous decisions quashing similar charges against other accused, affirming that the relief granted arose from the lack of substantial evidence against the petitioner. The central issue was whether the proceedings could be quashed under the aforementioned provision, to which the Court responded affirmatively based on precedents established in prior judgments.
