ORAL ORDER
This petition by accused Nos.32 and 33 in Spl.C.No.1055/2019 on the file of the LXXXI Addl. City Civil & Sessions Judge (CCH-82) (Special Court exclusively to deal with criminal cases related to elected former and sitting MPs / MLAs in the State of Karnataka), Bengaluru, is directed against the impugned order dated 05.06.2024 whereby the application filed by the petitioners – accused Nos.32 and 33 under Section 227 Cr.P.C. seeking their discharge from the impugned proceedings was rejected by the Trial Court.
2. Heard learned counsel for the petitioners, learned Addl. SPP for respondent No.1 and learned counsel for respondent No.2 and perused the material on record.
3. A perusal of the material on record will indicate that the respondent No.2 lodged a complaint on 09.06.2019 pursuant to which the impugned proceedings against 31 accused persons was registered on 30.08.2019 for the alleged offences punishable under Section 406, 409, 420 r/w 120B of IPC. Subsequently, on 01.09.2023, the 1st respondent – police filed supplementary charge sheet against the petitioners – accused Nos.32 and 33 which is currently pending in the instant Spl.C.C.No.1055/2019 for alleged offences pun
