ORAL ORDER
This petition is filed assailing the concurrent finding in respect of offence under Section 138 of the Negotiable Instruments Act, 1881 (for short, 'Act, 1881'). Petitioner before this Court is convicted to pay fine of Rs.5,30,000/- to the complainant for dishonour of cheque of Rs.5,00,000/-. 2. Learned counsel for the petitioner and the respondent jointly submit that the dispute is amicably settled.
3. A joint memo is also filed incorporating the terms and conditions of the settlement. The joint memo is signed by the learned counsel for the petitioner and the learned counsel for the respondent and also the petitioner and the respondent.
4. The petitioner/accused has agreed to pay the complainant Rs.4.00 lakhs in three instalments as incorporated in the joint memo. It is also recited in the joint memo that in case the accused/petitioner fails to pay the instalments, the orders of conviction rendered by the Trial Court and confirmed by the Appellate Court stand revived.
