ORAL ORDER
Petitioner/accused No.2 has preferred this petition under Section 483 of the BNSS, 2023 to enlarge him on bail in Crime No.81/2025 of Nazarbad Police Station, of Mysuru City, registered for the offence punishable under Section 109 , 126(2), 351(2), 352 and 3(5) of the BNS, 2023.
2. Heard both sides and perused the material on record.
3. Complaint lodged by one Nagaraju. B. reveals that the incident took place on account of a petty quarrel, wherein, accused Nos.1 and 2 named in the FIR are alleged to have attempted to assault him with axe and knife with an intention to commit his murder.
4. As per complaint averments, accused No.1 wielded a knife and when complainant tried to escape, he sustained bleeding injuries to his left ear. Vague allegations are made that even the petitioner, arraigned as accused No.2 has tried to assault complainant with an axe. However, it is not the case of the prosecution that the petitioner has inflicted injuries to the complainant. As per wound certificate, complainant has sustained simple injury.
