Since the issue involved in these petitions is similar, they are taken up together, heard, and disposed of by a common order.
2. In these petitions, the respondent has filed a private complaint under Section 200 of Cr.P.C., alleging that the petitioners, who are the owners of agricultural lands, extracted sand and transported it without obtaining a license from the competent authority, intending to sell it in the open market for unlawful gain.
3. Upon perusal of the complaint, the learned Magistrate took cognizance of the offence under Sections 21(1) and 21(2) of the Mines and Minerals (Development and Regulation) Act, 1957 (for short, “MMRD Act”).
4. Section 4(1A) of the MMRD Act states that no person shall transport or store, or cause to be transported or stored, any mineral except in accordance with the provisions of the Act and the rules made thereunder.
5. Section 21(1) of the MMRD Act deals with penalties and states that whoever contravenes the provisions of sub-section (1) or sub-section (1A) of Section 4 shall be punished with imprisonment for a term that may extend to two years, or with a fine that may extend to twenty-five thousand rupees, or with both.
6. Section 22 of the MMRD Act states that no court shall take cognizance of any offence punishable under this Act or any rules made thereunder, except upon a complaint in writing made by a person authorized in this behalf by the Central Government or the State Government.
