ORAL ORDER

1. Accused nos.1 & 2 in Crime No.202/2024 registered by Alur Police Station, Hassan District, for the offences punishable under Sections 126(2), 61(1), 118(1), 118(2), 109 & 190 of BNS, 2023, are before this Court under Section 483 of BNSS, 2023, seeking regular bail.

2. Heard the learned Counsel for the parties.

3. FIR in Crime No.202/2024 was registered by Alur Police Station, Hassan District, initially for the offences punishable under Sections 126(2), 109 of BNS, 2023, against unknown persons based on the first information dated 18.12.2024 received from Lingaraju - father of injured Dushyantha Kumar. During the course of investigation, accused no.1 was arrested on 05.01.2025 and accused no.2 was arrested on 08.01.2025. Their bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.106/2025 & Crl. Misc. No.130/2025 was rejected on 14.02.2025. Therefore, they are before this Court.

4. Learned Counsel for the petitioners submits that petitioners do not have any criminal antecedents. Investigation of the case is completed and injured victim has been discharged from the hospital and his condition is stable.

Accordingly, he prays to allow the petition.

5. Learned HCGP who has opposed the petition does not dispute the submissions made by the learned Counsel for the petitioners.

6. FIR in the present case was initially registered against unknown persons based on the first information received by the father of the victim - injured Dushyanth Kumar. During the course of investigation, petitioners herein and other accused persons have been arrested. After completion of investigation, the police have now filed charge sheet against six accused persons. Petitioners herein are arrayed as accused nos.1 & 2. It is not in dispute that petitioners do not have any criminal antecedents. It appears that petitioners and the injured have some financial dispute between themselves.
