ORAL JUDGMENT
2. For convenience, the parties are referred to based on their rankings before the trial Court. The appellant was defendant No.1; respondent No.1 was the plaintiff and respondent No.2 was defendant No.2.
The plaintiff filed a suit against the defendants for a declaration to declare that the plaintiff is absolute owner in possession of the suit property that the registered sale deed dated 26.05.2006, executed in favour of defendant No.1, by defendant No.2 regarding the suit schedule property is not binding on the plaintiff and for the consequential relief of permanent injunction.
3.2. The defendant No.1 filed a written statement stating that the suit is not maintainable either in law or on facts, and that the suit is liable to be dismissed.
