THIS CRL.R.P. IS FILED UNDER SECTION 397 OF CR.P.C PRAYING TO SET ASID THE IMPUGNED ORDER DATED 25.09.2023 PASSED BY THE PRL. DISRTICT AND SESSIONS JUDGE, DAVANAGERE IN CRL.A.NO.21/2022 CONFIRMING THE JUDGMENT AND SENTENCE DATED 15.03.2022 PASSED BY THE 1ST ADDL. CIVIL JUDGE AND JMFC CHANNAGIRI IN C.C.NO.504/2018 AND CONSEQUENTLY DISMIS THE COMPLAINT FILED BY THE COMPLAINT UNDER SEC.138 OF N.I.ACT.

THIS PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:

CONCILIATION ORDER

1. The petitioner - accused as well as the respondent – complainant are present. Both of them submit that the matter has been settled and the petitioner accused has undertaken to give a sum of Rs.2,50,000/- within a period of two months.

2. The respondent – accused is also agreeable to receive a sum of Rs.2,50,000/- in full and final settlement, provided the said sum is paid within two months, as undertaken by the petitioner –

accused.

3. The respondent submits that if the said amount is not paid, as undertaken, a default clause may be indicated in the Joint Memo.

4. The petitioner – accused agrees that if he is unable to pay a sum of Rs.2,50,000/- within two months, he would be liable to pay interest at the rate of 18% per annum from the date of the default. The matter is accordingly, settled.

5. It is agreed by both the parties that a sum of Rs.60,000/- is already in deposit before the Trial Court and the respondent – complainant may be permitted to withdraw the said amount. As a consequence, the petitioner – accused would be liable to pay a sum of Rs.1,90,000/- within a period of two months, as aforesaid. This Petition is, accordingly, disposed of, in terms of the Joint Memo.
