ORAL ORDER

This petition is filed under Sections 10 and 12 of the Contempt of Courts Act, 1971, seeking the following relief:

"THEREFORE, it is prayed that this Hon'ble Court may be pleased to summon, prosecute and punish the accused for his deliberate and willful disobedience in filing and deposing to false affidavit and interfering the administration of justice before the MMTC-III Bangalore in Crl. Misc.No.106/2022 by filing false assets and liabilities affidavit dated 03.01.2023 furnished as Annexure-A violating the judgment and guidelines laid down by Hon'ble Supreme Court of India in Rajnesh vs. Neha and others in SLP No.9503 of 2018 reported in (2021)2 SCC 324 produced the same before this Hon'ble Court as ANNEXURE-D. Thereby attracting Section 10 & 12 of Contempt of Court Act for initiation of contempt proceedings against the Accused, in the interest of justice."

2. The primary contention of the complainant is that the accused has filed false affidavit of Assets and Liabilities in C.Misc.No.106/2022.

3. It is submitted by the learned counsel for the accused that the complainant has already initiated the proceedings for perjury under Section 340 of Cr.P.C. and the said proceedings are pending.

4. In view of initiation of said proceedings under Section 340 of Cr.P.C., the prayer sought in the present contempt petition cannot be gone into. Accordingly, the contempt proceedings are dropped Notice issued to the accused is discharged.
